ISA Supports Appeal Of Signage-related Case To U.S. Supreme Court
Alexandria, VA - The International Sign Association (ISA) is supporting efforts by Ramsay Signs, Inc. and GK Travel Ltd., to appeal a contentious variance code case to the United States Supreme Court. The "petition for writ of certiorari" was filed on June 13, 2006, and asks the U.S. Supreme Court to overturn an erroneous decision by the Ninth Circuit Court of Appeals.
ISA President and CEO, Lori Anderson, notes that “We do not enter into this lightly. However, ISA believes that this case strikes at the very heart of the sign industry. Appealing GK Ltd. Travel vs. the City of Lake Oswego to the Supreme Court will provide a highly visible public platform on which to reaffirm basic tenets of free commercial speech and property rights that this case, and others like it, have eroded.”
The case hinges on two variance requests made to the city of Lake Oswego back in 2002. After both requests were rejected by the city, the case has since been tied up in the Court system, including an unfavorable ruling January 26 by the Ninth Circuit Court of Appeals.
“With the support of ISA and our industry peers,” says Anderson, “we are committed to seeing this rare opportunity for justice through to completion. In addition, we are intent on sending a message to industry detractors that we stand ready to fight for the constitutional rights of sign users.”
